car fraud , what happens ?

Hi all , we know of a person who  had a mva on a friday , but said in the insurance claim it was on a saturday , also arranged with the other driver to say it was saturday as well. they put a claim in for insurance to fix their car, two weeks later  the insurance company wanted phone records 3 days before and after mva . the same day the insurance company said they wanted the phone records , the person who was claiming rang back and told the insurance company she told them she  lied about the claim but  didnt withdraw the claim . insurance company  told her that they would see what the manager says about the claim etc.  what do you all think , will they charge her for car fraud  or not pay the claim? .

The Insurance company will not pay the claim, and more than likely pass on the info to the police to investigate.

They may call back and say that if she withdraws the claim, then the insurers will not press charges.

That is the offer they gave to a guy I know who got caught padding a claim after his house got broken into.  He tried to claim an ipod, used a friend's receipt to prove it, got caught and they made him the offer of 'you walk away, we walk away'.

update on this matter ,the insurance company have pass the file to the police to investigate . do you think the police will charge this person with fraud . she has even gave to the insurance company a signed statment on what she had done to get her car fixed .

I am only a newby to the investigation ranks but I have been involved in inspecting motor vehicle theft, staged accidents and mechanical fires for about 6 years. I asked that question to the state mananger of a very large insurance company.

The answer I was given was that if any inconsistencies are found within the claim the in house investigators will investigate the matter first. If enough evidence is found to proceed it is handed onto independant investigators to be looked into further. If the external investigation is conclusive that the claim is fraudulant  the insurance company will just deny the claim on those grounds.

They will cancel the policy and not re insure the claimant.

I asked if fraud charges are then proceeded with and the answer I got was NO, The police don't have the man power to follow up on all the matters.

The only time that they will pass the file onto the police if they suspect that the claimant has multiple claims of the same nature etc.
